Terms of Service
Effective Date: 10/27/2026
Last Updated: 10/27/2026
Welcome to lumberjimep.com! These Terms of Service ("Terms") are an agreement between you and A Headful, LLC, doing business as LumberJim ("LumberJim," "we," "us," or "our"). They cover your use of lumberjimep.com (the "Site") and the services, products, custom orders, and content we offer. Please read them before you use the Site, request a quote, place an order, or post a comment.
By using the Site, requesting a quote, placing a custom order, creating an account, or buying from our Etsy shop, you agree to these Terms and our Privacy Policy, and you confirm that (1) you're old enough to form a binding contract where you live, and (2) if you're acting for a business or organization, you have the authority to agree on its behalf. If you don't agree, please don't use the Site or our services.
Some features have extra terms that we post separately ("Supplemental Terms"), such as our Tree Care Service Disclaimers, Return & Exchange Policy, Shipping Policy, and the official rules for any contest. Supplemental Terms are part of these Terms and control on their specific topic if there's a conflict. Some tools we use (Etsy, Wix, Threadless, Redbubble, Google) are provided by third parties under their own terms, and your relationship with those companies is governed by those terms.
1. Our Services
LumberJim provides:
-
Tree Care: Trimming, cutting, and removal of trees under 25 feet, shrubs, and bushes
-
Woodworking & Carpentry: Handmade furniture and home decor, sold at farmers markets, by custom order, and through our Etsy shop
-
Collections: Custom home decor pieces crafted from a customer's own tree material, named after the source property's street address
-
Educational Content & Merchandise: Woodworking plans, how-tos, and advice shared on this Site to help others learn and recreate projects, plus branded merchandise sold through third-party print-on-demand platforms (Threadless and Redbubble)
2. Quotes & Tree Care Services
-
Quotes submitted through our Site are estimates only and are not final until confirmed following an on-site assessment.
-
Final pricing may vary based on tree size, condition, accessibility, and other conditions discovered at the time of service.
-
LumberJim carries general liability insurance. LumberJim does not hold arborist certification, and nothing on this Site should be read as a claim of such certification.
-
Weather, property access, and other conditions outside our control may require rescheduling.
-
Payment terms, hazard disclosure, and scope of work are covered in our Tree Care Service Disclaimers.
3. Custom Orders & Collections
Deposits
-
Custom orders and Collections pieces require a 50% deposit before work begins.
-
If you cancel before the set cancellation date (communicated when you order), half of the deposit is refundable.
-
If you cancel after the set cancellation date, the deposit is non-refundable.
Cancellations
-
You may cancel a custom or Collections order at any time before work begins.
-
We'll email you when work on your order begins. Once that email has been sent, the order is in progress and is no longer eligible for cancellation or the deposit refund described above.
Collections-Specific Terms
-
Collections pieces are made from material sourced from a specific customer's property and tree. Because each piece is one-of-a-kind, exact grain, color, size, and yield can't be guaranteed in advance.
-
If the source material isn't enough to complete the requested piece(s), we'll contact you to talk through options, which may include a design adjustment, partial refund, or alternative material by agreement.
-
Collections pieces are final sale once completed and delivered, except for defects in craftsmanship.
Timelines
-
Timelines for custom orders and Collections pieces are communicated when you order and are estimates. Delays due to material availability, weather (affecting source tree material), or order volume can happen, and we'll let you know about significant changes.
4. Standard Product Orders & Merchandise
-
Standard, ready-to-ship, or made-to-order woodworking items are currently purchased through our Etsy shop and are subject to Etsy's terms and policies as well as ours. Returns and shipping are covered in our Return & Exchange Policy and Shipping Policy.
-
Merchandise sold through Threadless and Redbubble is sold, shipped, and supported by those platforms, not by LumberJim. Questions about merchandise orders, returns, and payment should go to the platform you bought from.
-
Once native e-commerce is available directly on this Site, these Terms will be updated to reflect direct payment processing.
5. Accounts
If member accounts are offered on the Site:
-
Registration: Give us accurate, current, and complete information when you sign up, and keep it updated. You can't create an account if you've been barred from using the Site, and you may only keep one account.
-
Your Login: Keep your password private and don't share your account. You're responsible for everything that happens under your account. Tell us right away at the email in Section 17 if you think someone has used it without permission.
-
Ownership of Accounts: Your account is for your personal use. You don't own the account or username itself, though you keep ownership of content you post (see Section 6). We may remove or reclaim usernames at any time.
-
Suspension and Closing: We may suspend or terminate an account, or restrict your ability to comment, at our discretion, including if you violate these Terms, with or without notice. You can close your account at any time by emailing us.
6. Comments, Reviews & Other User Content
-
Comments are public. Anything you post may be seen, used, and copied by anyone, so please don't include personal, sensitive, or confidential information.
-
You're responsible for what you post. Everything you submit through the Site ("Your Content"), including comments, reviews, testimonials, survey answers, and suggestions, is your sole responsibility. Use other people's content and interact with other users at your own risk.
-
You keep ownership. We don't claim ownership of Your Content. By posting or sending it to us, you promise you have the rights needed to do so, and you give LumberJim a non-exclusive, royalty-free, worldwide license to display, store, and reproduce it on the Site, and to share it in our own promotion (social posts, emails, and other pages on the Site). When we use Your Content in promotion, we'll identify you by first name only, or anonymously, never by your full name or email address. You won't be paid for this use.
-
Removal. If you ask us to remove your comment, we'll take it down from the Site going forward. We can't pull back content that has already gone out in emails or social posts.
-
Reviews and testimonials. To keep these honest, you agree that (a) your review reflects your actual, first-hand experience, (b) you don't have a competing, ownership, employment, or other financial interest in what you're reviewing, (c) you're not posting it in exchange for payment or other benefits, and (d) it follows these Terms. We may exclude or remove any review that we think undermines the integrity of reviews.
-
What not to post. Don't post anything that: infringes someone else's rights (copyright, trademark, privacy, publicity, or others); is unlawful, threatening, abusive, harassing, defamatory, deceptive, obscene, offensive, or invasive of someone's privacy; is spam, junk mail, or unauthorized advertising; involves selling, promotions, contests, or links for commercial purposes without our written permission; or impersonates someone or misrepresents your connection to a person or business.
-
We moderate. We don't pre-screen comments, but we review them and may remove any that are offensive, abusive, spammy, not relevant, or that violate these Terms, at our discretion and without notice. We're not required to publish or keep any comment, and we may disclose information when needed to follow the law or a government request.
-
Comments are the commenter's, not ours. We don't endorse commenters' opinions and aren't responsible for them. Comments are not covered by the Content Use License in Section 8.
7. Contests, Giveaways & Surveys
Any contest, giveaway, sweepstakes, or other promotion on or through the Site is governed by its own official rules, which are part of these Terms. If the official rules conflict with these Terms, the official rules control for that promotion. Void where prohibited by law.
8. Using This Site: Ownership, Content Use & Restrictions
Ownership
The Site and its content (other than Your Content and other users' content) are owned by LumberJim or its licensors and are protected by copyright and other intellectual property laws. Our logos, brand names (including "LumberJim" and the "Collections" naming concept), photographs, and product designs remain the property of LumberJim and are not covered by the license below unless we say otherwise in writing. Other trademarks and names on the Site belong to their owners. Please don't remove or hide any copyright or trademark notices.

9. Disclaimers
Informational Content
-
The information on this Site is provided for informational purposes only, to guide readers toward developing skills. We can't guarantee that it will ensure your success. Many factors affect your ability to succeed, and everyone defines success differently.
-
Content is based on research, professional experience, and the personal experience of its writers, and it does not constitute professional advice. These are approaches that make sense or have worked for the writers in the past, and we hope they work for you too. You're responsible for checking that information is right for your situation.
-
Woodworking and tree work carry inherent risk. Follow manufacturer instructions, use appropriate safety equipment, and use your own judgment before attempting any project or technique described on this Site.
Editorial Standards & Corrections
We aim to share well-researched information without bias or political leaning. Content is reviewed after it is written, and may be updated when needed to add new information or make corrections. Reasonable efforts are made to keep information accurate and up to date. If you notice something that needs to be corrected, please contact us at the email in Section 17.
Affiliate & Advertising Disclosure
Some educational content may contain affiliate links, meaning we may earn a commission on qualifying purchases at no additional cost to you. We only link to products we have actually used. As an Amazon Associate, we earn from qualifying purchases. The Site may also display Google AdSense advertisements as a form of support. See our Privacy Policy for how advertising and affiliate cookies work.
Third-Party Links
Our Site links to websites and services we don't own or operate. We don't control them, don't review or endorse them, and aren't responsible for their content, products, or privacy practices. Using them is at your own risk, and we won't warn you when you leave the Site.
The Site Is Provided "As Is"
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS FREE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES ABOUT THE SITE AND ITS CONTENT, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME STATES DON'T ALLOW LIMITS ON IMPLIED WARRANTIES, SO PART OF THIS MAY NOT APPLY TO YOU.
This disclaimer is about the Site and its free content. It doesn't take away the specific terms that apply to products and services you buy from us, including the craftsmanship-defect exceptions in our Return & Exchange Policy.
10. Indemnification & Limitation of Liability
Indemnification
You agree to indemnify and hold harmless LumberJim and its owners, employees, and contractors from any damages, losses, and expenses (including reasonable attorneys' fees) arising from claims about: Your Content; your misuse of the Site; your violation of these Terms; your violation of someone else's rights; or your violation of any law.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LUMBERJIM IS NOT LIABLE FOR ANY LOST PROFITS OR REVENUE, OR FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA OR USE, ARISING FROM YOUR USE OF THE SITE OR ITS CONTENT, EVEN IF WE'VE BEEN ADVISED THEY MIGHT OCCUR.
FOR CLAIMS ABOUT YOUR USE OF THE SITE AND ITS CONTENT, OUR TOTAL LIABILITY WON'T EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DURING THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR (B) $100. THIS CAP DOESN'T APPLY TO LIABILITY FOR DEATH, PERSONAL INJURY, OR PHYSICAL PROPERTY DAMAGE CAUSED BY OUR NEGLIGENCE, OR TO FRAUD. SOME STATES DON'T ALLOW CERTAIN LIMITS ON DAMAGES, SO PART OF THIS MAY NOT APPLY TO YOU.
For Tree Care work and for products and custom pieces, liability is addressed in our Tree Care Service Disclaimers, the terms of your order, and our insurance coverage, and nothing in these Terms limits obligations required under that coverage.
These limits are a fundamental part of the deal between you and us. They survive the end of your access to the Site.
11. Termination
We may modify, suspend, or discontinue the Site, or change, suspend, or end your access to it (including commenting and accounts), at any time and for any reason, with or without notice, and without liability to you or anyone else. We also reserve the right to take appropriate legal action for misuse of the Site. Ending your access doesn't cancel obligations for orders or deposits already made under Section 3.
12. Copyright Complaints
If you believe content on the Site, including a comment, infringes your copyright, please email us at the address in Section 17 with:
-
A description of the copyrighted work you believe was infringed
-
Where the material appears on the Site (the page link)
-
Your name, email address, and phone number or mailing address
-
A statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent, or the law
-
A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner
We'll review your notice and may remove the material. We may end access for people who repeatedly infringe copyrights.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of our Site or services will be resolved in the state courts located in El Paso County, Texas, or the federal courts for the Western District of Texas, El Paso Division, and you consent to the jurisdiction of those courts.
14. General Terms
-
Electronic Communications: We communicate with you electronically, by email or by posting on the Site. You agree to receive notices, disclosures, and other communications from us electronically, and that they satisfy any requirement that they be in writing. This doesn't affect your statutory rights.
-
Notices: Keep your email address current. If an email we send to the address you gave us fails or can't be delivered, our sending it still counts as notice. You can give notice to us by emailing the address in Section 17.
-
Visitors Outside the U.S.: We operate from the United States and make no promise that the Site is appropriate or available elsewhere. If you use it from another country, you're responsible for following local laws.
-
Entire Agreement: These Terms (with the Privacy Policy and Supplemental Terms) are our complete agreement on their subject matter and replace earlier discussions about it.
-
Severability and No Waiver: If any part of these Terms is found unenforceable, it will be applied as closely as possible to what was intended, and the rest stays in effect. If we don't enforce a provision on one occasion, that doesn't waive it on another.
-
Events Outside Our Control: We aren't liable for delays or failures caused by things outside our reasonable control, such as severe weather, fire, floods, accidents, illness, supply or carrier delays, shortages of materials, or acts of civil or military authorities.
-
Assignment: You can't transfer your rights or obligations under these Terms without our written consent. We may transfer ours in connection with a sale or reorganization of our business.
15. California Consumer Complaints

16. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, business practices, or legal requirements. Updates take effect when posted on this page, and the "Last Updated" date at the top will show the most recent revision. Continuing to use the Site after changes are posted means you accept them. Changes won't alter the terms of an order you've already placed.
